PUBLIC OFFERfor the Provision of Tourist Services1. General Provisions
1.1. This document constitutes an official offer (public offer) of Individual Entrepreneur ROMAN ANDREEVICH ANDRIANOV, TIN 519034690373, OGRNIP 324510000024072 (hereinafter referred to as the “Contractor”) to enter into an agreement for the provision of tourist and organizational services with any individual (hereinafter referred to as the “Customer”) under the terms and conditions set forth in this Public Offer.
1.2. This Public Offer determines the terms and conditions for ordering, payment for, and provision of tourist and organizational services by the Contractor.
1.3. Acceptance of this Public Offer shall mean that the Customer performs actions indicating acceptance of its terms, including submitting an application through the Contractor’s website, messengers, social media, or by telephone, as well as making full or partial payment for the selected services.
1.4. From the moment of acceptance, the agreement between the Contractor and the Customer shall be deemed concluded on the terms and conditions of this Public Offer.
2. Subject of the Agreement2.1. The Contractor provides the Customer with services for organizing author’s tours and travel experiences.
2.2. Depending on the selected program, the services may include:
- selection and development of an itinerary;
- accommodation arrangements;
- organization of individual services included in the travel program;
- group assistance and support;
- informational and consulting support;
- coordination of the trip;
- other services specified in the description of the particular tour.
2.3. The specific scope of services, travel program, dates, destination, price, and other material terms shall be determined by the information published on the Contractor’s website, social media, messengers, or agreed individually with the Customer.
3. Application Procedure3.1. The Customer may submit an application through:
- the Contractor’s website;
- messengers, including WhatsApp, Telegram, and other means of communication used by the Contractor;
- social media;
- telephone;
- other communication channels used by the Contractor.
3.2. When submitting an application, the Customer shall provide accurate information necessary for organizing the trip and providing the services.
3.3. After the terms of the trip have been agreed upon, the Contractor confirms the Customer’s participation in the selected tour.
3.4. A place on the tour shall be considered reserved after the Contractor receives the relevant payment, unless otherwise expressly agreed by the parties.
4. Service Price and Payment Procedure4.1. The price of the tour shall be stated on the Contractor’s website or communicated to the Customer individually before payment is made.
4.2. Payment for the services may be made:
- in the amount of 100% of the total price;
- in the form of a partial payment (advance payment) to reserve a place;
- by another method agreed upon by the parties.
4.3. The amount of the advance payment, the deadline for payment of the remaining balance, and other payment terms shall be specified in the description of the particular tour or communicated to the Customer when submitting the application.
4.4. The Customer’s payment obligation shall be deemed fulfilled upon receipt of the funds by the Contractor or confirmation of payment by the relevant payment system.
4.5. In the event of late payment of the remaining balance, the Contractor shall have the right to suspend further arrangements for the trip until payment is received, unless otherwise provided by the agreed terms of the particular tour.
4.6. All payments shall be made in Russian rubles unless otherwise provided by applicable law of the Russian Federation.
5. Cancellation of the Trip and Refund Procedure5.1. The Customer has the right to withdraw from the agreement and cancel participation in the trip in accordance with the legislation of the Russian Federation.
5.2. If the Customer cancels the trip, the Contractor shall refund the amounts received, less the actual and documented expenses incurred in connection with fulfilling the Contractor’s obligations under the Customer’s specific booking.
5.3. Actual expenses may include, in particular, expenses related to the booking and payment of accommodation, transportation services, tickets, meals, excursions, services of third-party providers, insurance, and other services purchased by the Contractor for the purpose of fulfilling its obligations to the Customer and which are non-refundable to the Contractor or refundable subject to deduction of the relevant amounts.
5.4. The amount of actual expenses shall be determined based on the expenses incurred by the Contractor in connection with fulfilling its obligations under the specific trip booked by the Customer.
5.5. If the Customer cancels the trip immediately before its commencement or during the provision of the services, the refund amount shall be determined taking into account the actual expenses incurred by that time.
5.6. If the Customer fails to appear at the departure point without prior notice to the Contractor, any refund shall be determined taking into account the actual expenses incurred by the Contractor. If the actual expenses equal the full amount paid, no refund shall be due.
5.7. To request a refund, the Customer shall submit a corresponding request to the Contractor using an available communication channel or another method specified by the Contractor.
5.8. The time and method of refund shall be determined in accordance with applicable legislation of the Russian Federation and taking into account the processing time required by the relevant bank or payment provider.
5.9. Cancellation and refund terms may be further specified for individual travel programs, taking into account the booking conditions of third-party service providers. Such terms shall be communicated to the Customer before payment is made.
6. Rights and Obligations of the Parties6.1. The Contractor shall:
- organize the trip in accordance with the agreed program;
- provide the Customer with the necessary information regarding the terms of the trip;
- provide informational and organizational support within the agreed scope of services;
- comply with the terms of the agreement concluded with the Customer.
6.2. The Customer shall:
- provide accurate information to the Contractor;
- make timely payments;
- comply with safety requirements;
- comply with accommodation, conduct, and local rules applicable during the trip;
- follow reasonable instructions and recommendations of accompanying personnel;
- promptly notify the Contractor of circumstances that may affect the Customer’s participation in the trip.
7. Liability of the Parties7.1. The parties shall be liable for failure to perform or improper performance of their obligations in accordance with the legislation of the Russian Federation.
7.2. The Contractor shall not be liable for consequences arising from circumstances beyond the Contractor’s reasonable control, including actions of third parties, delays or cancellations of transportation, changes in carrier schedules, weather conditions, and other circumstances that directly affect the possibility or manner of providing the services.
7.3. The Contractor shall not be liable for decisions and actions independently taken by the Customer during the trip if such actions were not caused by improper performance of the Contractor’s obligations.
7.4. If circumstances arise that prevent the trip from being conducted in the originally agreed format, the Contractor shall inform the Customer and take reasonable measures to modify the organization of the trip within the Contractor’s capabilities and in accordance with the requirements of applicable law.
8. Personal Data Processing8.1. The processing of the Customer’s personal data shall be carried out in accordance with Federal Law No. 152-FZ “On Personal Data” dated July 27, 2006, and other applicable laws and regulations of the Russian Federation.
8.2. When submitting an application, the Customer may provide the Contractor with the following personal data:
- surname;
- first name;
- patronymic;
- telephone number;
- email address;
- information required for organizing the trip and providing the selected services;
- other information voluntarily provided by the Customer or required for the performance of the agreement.
8.3. By providing personal data to the Contractor, the Customer consents to the processing of such data for the following purposes:
- entering into and performing the agreement;
- organizing and coordinating the trip;
- booking services necessary for the performance of the agreement;
- communicating with the Customer;
- providing customer support;
- notifying the Customer of changes related to the trip;
- monitoring the quality of the services provided;
- processing the Customer’s inquiries and reviews.
8.4. Where the Customer has provided separate consent, the Customer’s personal data may also be processed for the purpose of sending informational and advertising communications regarding the Contractor’s services, conducting marketing activities, surveys, and other promotional activities.
8.5. By submitting a review regarding the services purchased, the Customer consents to the Contractor’s use of the text of such review in informational and advertising materials, unless otherwise follows from the content of the review or from a separate request made by the Customer.
8.6. For the purposes of this Public Offer, “processing of personal data” means any action (operation) or set of actions (operations) performed with or without the use of automation tools in relation to personal data, including collection, recording, systematization, accumulation, storage, clarification (updating or modification), retrieval, use, depersonalization, blocking, deletion, and destruction of personal data.
8.7. The Contractor may use “cookies” technology on its website. Cookies may be used to ensure the operation of the website, analyze website traffic, improve website performance, and generate statistical data.
8.8. Where permitted by applicable law, data obtained through cookies may be processed using third-party services used by the Contractor for website operation, analytics, and advertising purposes.
8.9. The Contractor may receive technical information regarding visits to the website, including the visitor’s IP address. Such information is used for website operation, security, statistics, and analytics and, by itself, is not used by the Contractor to identify the visitor.
8.10. Where necessary, the Contractor may record telephone conversations with the Customer for the purposes of quality control, documenting agreements, and resolving potential disputes, provided that such recording complies with the requirements of applicable legislation of the Russian Federation.
8.11. The Contractor shall take the necessary organizational and technical measures to protect personal data against unlawful or accidental access, destruction, modification, blocking, copying, dissemination, and other unlawful actions.
8.12. Personal data may be transferred to third parties where and to the extent necessary for the performance of the agreement, including organizations directly involved in arranging the trip, where such transfer is necessary to provide services paid for by the Customer and is permitted by applicable law of the Russian Federation.
9. Amendments to the Public Offer9.1. The Contractor has the right to amend this Public Offer.
9.2. The new version of the Public Offer shall become effective from the moment it is published on the Contractor’s website, unless otherwise provided in the new version.
9.3. The version of the Public Offer effective at the time of acceptance shall apply to the relationship between the Contractor and the Customer unless otherwise provided by applicable law of the Russian Federation.
10. Final Provisions10.1. Matters not regulated by this Public Offer shall be governed by the legislation of the Russian Federation.
10.2. If any provision of this Public Offer is declared invalid or unenforceable, this shall not affect the validity of the remaining provisions of the Public Offer.
10.3. Information regarding a specific tour, including its itinerary, dates, price, scope of services, and other terms, shall form part of the contractual relationship between the Contractor and the Customer upon confirmation of the application and payment.
